Sometimes while going through a divorce, spouses realize that they don’t want to end their marriage and decide to give it another try. What happens then?
If a judgment of divorce has already been issued, then the parties are legally single. If they would like to be married again, they will need to remarry.
If the divorce is still ongoing, the parties may want to pause doing any work on the case or pursuing any actions through the court while they work through their reconciliation. This may mean continuing or dismissing any upcoming hearings or other court events. This should be carefully considered because if a hearing or trial is taken off calendar, it will need to be refiled or rescheduled if the parties do end up proceeding with the divorce.
The parties can also file to dismiss the divorce case. This will end the case and if either party wishes to divorce in the future, they will need to file a new petition.
If the parties have signed a marital settlement agreement, they should read it carefully to see how it is impacted by their reconciliation. Many settlement agreements have a provision that keeps the terms of the agreement in effect, even if the parties reconcile, unless there is a new signed writing.
