The new year is coming - what does that mean for your divorce and tax filing status?

When you get a divorce, your tax filing status changes in the year you receive your judgment, not the year you file for divorce.

This means that if you were rushing to file for divorce before the new year for tax purposes, there is no need to hurry. It takes a minimum of 6 months and 1 day from the date the other party is served or the date the other party responds, whichever comes first, for a divorce to be final in California. There is no way for you to complete the divorce process and have the divorce be final before the end of this year. However, there may be other reasons to file for your divorce sooner rather than later. If it has been at least 6 months and 1 day since the service of the petition or the filing of a response, but you haven’t settled your divorce or gotten that judgment packet in, this may be the time to try to settle those last issues and submit the paperwork. Whether your divorce will be completed by the end of the year will depend on how busy it is at your county courthouse. This time of year gets busy as many people try to get their divorces completed before January 1.
