i want a divorce. now what?

Once you’ve decided you want to get divorced, there are several things you can do to get the process started and going as smoothly as possible. Please note that these steps are only for people who do not have any concerns for their safety as they go through the divorce process. If you have concerns for your safety as you divorce, please contact an attorney, a courthouse self-help center, or the police for more information.

  • Talk to your spouse. Let the other person know you want to divorce and try to talk about how you would like the process to go. Would you like to pursue mediation? Is an uncontested divorce or summary divorce right for you? The two of you may be able to agree on all or many issues, and that will save you a lot of time and money as you go through the legal process.
  • Gather your financial and legal documents. You’ll need things like the titles to any property, titles to cars, insurance policy information, bank statements, loan information, and retirement account and pension information. These documents will be needed to provide the financial disclosures you’ll make during the divorce, so having them gathered will be helpful. They are also helpful in figuring out what needs to be divided and how you will divide things.
  • Learn about your options. Check out your county’s superior court website in the Family Law section and Self Help section or talk to an attorney. This will help you understand what you need to do to get a divorce, what papers need to be filed, and what kind of timeline you’ll be looking at.
